We are pleased to welcome back Brad Huss with an ERISA Litigation update.  Brad will update us on important new developments in ERISA case law, including several cases on service provider liability for revenue sharing, the Ninth Circuit's recent revival of a breach-of-fiduciary-duty lawsuit over a drop in value of employer stock held by a retirement plan, a new decision holding that ESOP fiduciaries can be indemnified by the plan sponsor, a recent Ninth Circuit decision addressing particular considerations fiduciaries must undertake when deciding which investment funds to offer under a retirement plan, a recent Supreme Court decision addressing the scope of equitable relief under ERISA, and a significant case up for review by the Supreme Court involving the enforceability of a plan-specified limitations period to bring suit for benefits.

Bradford "Brad" Huss is a member of the San Francisco law firm of Trucker Huss, APC, which practices exclusively in the fields of ERISA and employee benefits.  Mr. Huss concentrates his practice on qualified pension and profit sharing plans, ERISA litigation, fiduciary responsibility matters and Department of Labor investigations.  Mr. Huss has spoken numerous times throughout the country on qualified plan and fiduciary responsibility matters and has testified before the United States Senate Finance Committee concerning retirement security issues.  Mr. Huss is a Charter Fellow and a former member of the Board of Governors of the American College of Employee Benefits Counsel.  Mr. Huss is a past member of the Board of Directors of the American Society of Pension Professionals and Actuaries, a former chair of the Employee Benefits Committee of the Section of Tort Trial and Insurance Practice of the American Bar Association and a Past President of the San Francisco Chapter of the Western Pension & Benefits Council.
